Telangana High Court’s Key Decisions: Death Sentence Review, ‘Vyuham’ Film Orders Reserved, and Inspector’s Anticipatory Bail Plea

 

The Telangana High Court has given the state two weeks to provide a report on the death sentence given to Imran UI Haq. He was convicted by the Nampally Criminal Court for murdering his wife by stabbing her neck with scissors.

The High Court bench, comprising Justice K Lakshman and P Sree Sudha, is reviewing the case for confirmation of the death sentence. The IV Additional Metropolitan Sessions Judge ordered that the death sentence should not be carried out until confirmed by the High Court. The matter has been adjourned to February 15 for further review.

In another case, the Telangana High Court has reserved orders on the political film ‘Vyuham.’ Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti are handling writ appeals filed by the film’s producer and director against a single judge’s order.

The film allegedly depicts political figures like Chandrababu Naidu, Pawan Kalyan, and Nara Lokesh in the context of key political events in Chief Minister Jaganmohan Reddy’s life. The court heard arguments from both sides and reserved the case for orders after three days of deliberation.

Inspector B Durga Rao, suspended and accused of favoring former Bodhan MLA Shakeel Aamir’s son Raheel Aamir, has sought anticipatory bail from the Telangana High Court. The police officer is accused of assisting the prime accused under the influence of another Nizamabad Police inspector, also implicated in the case.

Various charges under the IPC, Motor Vehicle Act, and the Prevention of Damage to Public Property Act have been registered. Durga Rao claims that media pressure and political influence led to his implication as an accused even before an investigation. The case may be taken up in the next two working days of the court.

Hyderabad, India – In a significant ruling, the Telangana High Court has dismissed a writ petition filed by the Praja Shanthi Party, led by Dr. KA Paul, seeking directions to the Election Commission of India (ECI) to allot a common symbol for their party. The court observed that the party’s failure to produce annual accounts, financial statements, and election expenses was a valid reason for the ECI’s rejection of their request.

Background

The Praja Shanthi Party, a registered political party since 2019, had applied for a common symbol of either a “helicopter” or a “ring” for the upcoming elections. However, the ECI rejected their application on the grounds that the party had not submitted the required financial documents.

Court’s Reasoning

The two-judge bench comprising Chief Justice Alok Aradhe and Justice NV Shravan Kumar upheld the ECI’s decision, stating that the petitioner’s case could not be considered due to their non-compliance with the ECI’s guidelines. The court further noted that the ECI’s rejection order was not challenged before the court, and therefore, they could not interfere with the ECI’s decision.

Implications

The court’s decision has significant implications for the Praja Shanthi Party, as it will make it difficult for them to campaign effectively without a common symbol. The party may have to rely on individual candidates using their own symbols, which could confuse voters.

Other Cases

In separate cases, the same bench also addressed writ petitions filed by Feroz Khan, a Congress candidate for the Nampally Constituency, and B Ram Mohan Reddy, president of the Telangana Yuva Shakti Party.

Khan’s petition challenged the ECI’s failure to provide a list of absent, shifted, dead, and duplicate voters. The court, while refusing to accept Khan’s contention that the absence of the list would hamper the confidence quotient of the election process, granted him an opportunity to raise other contentions.

Reddy’s petition sought directions to the ECI for allotting a common symbol for his party. The court issued notices to the ECI and adjourned the matter.
